Terms & Conditions

Kings Ark Dance Academy (KADA) Terms and Conditions aim to present a fair sustainable structure to all. We aim to provide the highest quality classes for all our customers.

We are committed to the safety of all persons who attend our lessons and to deliver the highest standard of service.

Participating in a KADA class is entirely at your own risk without any proven negligence, breach of duty of care or lack of due diligence by KADA.  KADA employees and/or contractors will not assume responsibility for any bodily or personal injury consisting of, or arising out of any participation in any physical training or athletic activity.

Registration and Data Protection

The information we require upon registration contains personal data. KADA will record, process and keep your personal information secure in accordance with General Data Protection. If your child is taking an ISTD, LCM or Acrobatic Arts exam these boards will require the child’s name, DOB and ethnicity. Our local council will also require this information if your child takes part in our shows to issue a BOPA.

Fees and Payment Methods

Fees are based on a 10-13 week term and are payable in advance via online monthly payments spread out throughout the year. If your child turns up to class without installments having been paid, and unless you have a prior written agreement with KADA regarding fee payment, they will not be allowed to participate.

Invoices will be provided prior to the start of each term, Payment is via GoCardless, a direct debit service, you will receive a link when you join.
Receipt of payment will be emailed.

All students must be registered for the classes they attend. Unregistered children will not be allowed to participate in the class.

Discontinuing your classes

Should you wish to discontinue your classes, please do contact us as we require a terms notice. For example, if your child wishes to stop after a few weeks, you will still be charged for the rest of the term.

Physical Contact

From time to time it is necessary for the teachers to use physical contact when helping to improve pupils’ posture or assist in movements. This includes physical contact between students i.e. holding hands.

AcroDance Classes

Participating in acrobatic dance involves inherent risks and hazards. By participating in this class you freely accept and fully assume all such risks, dangers, and hazards and the possibility of personal injury or loss resulting from such risks and hazards.

First Aid

We always have a first aider on site in our classes who will provide basic first aid. By agreeing to these terms and conditions you authorise KADA to seek medical services in case of serious injury or illness if you cannot be contacted.

Uniform and Appearance

Pupils are required to attend class wearing the correct dance wear and their KADA T-shirt

Videos and photographs

Please do not post anything onto social media which contains any child other than your own. If you are asked to stop, please do respect the rights of others. In addition, if the Class Teacher feels that the amount of video is excessive, not just short clips, then you may be asked to stop.

For all classes – Photographs and videos for our website, press, promotional development, class development and our social media pages will be taken by your childs teacher in class, possibly shared amongst our team as a teaching resource, alongside professional recordings of shows by a third party.

By agreeing to these terms and conditions you understand you are consenting for your child to be part of this and allowing these images to be possibly posted online.

Pupils are forbidden to take photos or videos in class without the teachers consent. If consent is given then they are only to be used as a learning resource and never posted to any social media pages or shared with others outside of the class. Please make your child aware of this.

Refunds, Paused Direct Debits, Holidays and sickness policy

Regrettably we cannot offer refunds or pause direct debit payments to cover your booked holidays, illness or any other reason why you may miss a class or workshop, due to the need to ensure continuity of service.

Should any pupil wish to discontinue any class or leave the school, refunds for any unused classes will not be given.

If you miss more than 3 classes in a term your child may not be able to participate in that section of their show dance.

Supervision and withdrawal of service

KADA endeavor to ensure that your children are dancing in a safe and comfortable environment. We ask you to bring and collect your child promptly and provide us with emailed details of changes in drop off/pick up arrangements, special medical needs etc.

All children under the age 3 must have a parent or guardian present on the premises at all times.

For the rest of our classes – If your wish for your child to wait unattended on our premises for a class, we cannot be held responsible for them. We cannot be held responsible for pupils outside of our class. e.g if you wish for your child to go home unsupervised, that is your responsibility.

Should a pupil, carer or associated visitor behave in a way that the Class Teacher feels is unreasonable or a serious breach of the school’s terms and condition or any other serious misconduct then KADA reserves the rights to withdraw the provision of classes to the client without notice.

Renewals

We will assume you will be continuing with our classes each term unless we are informed otherwise, by email, phone or in person.

Cancellation of Classes policy

KADA will endeavor to run classes during bad weather e.g. snowy conditions. However should we need to cancel due to safety concerns, parents will be notified/contacted (please check our Facebook page and make sure your phone number is kept up to date on our register).
An additional class will be offered if we have to cancel a class or refund against a future term’s fees. Regrettably we cannot automatically offer cash refunds.

Illness

Parents are asked to keep their children at home if they have a serious infection and to inform KADA as to the nature of the infection so that other parents can be alerted.
Please keep your child at home if he/she:

  • Has a fever or has had one in the previous 24 hours

  • Has had an upset stomach or diarrhoea in the previous 48 hours

  • Has heavy nasal discharge

  • Has discharging eyes

  • Has symptoms of a possible communicable diseases

  • Measles

  • Chicken pox

  • German measles

  • Whooping cough

  • Impetigo

  • Scarlett fever

  • Hand, foot and mouth disease

  • Norovirus

  • Covid 19

We cannot offer a refund for a lesson missed due to illness.

KADA has a commitment to ensure that the equipment and activities are value and worth to everyone regardless of race, culture, language, gender, age, experience, religion, background, ability or disability.

Protection of property

KADA cannot take any responsibility for any loss or damage to personal items brought or left on the premises.

Health & Safety and Hygiene Policies

KADA follows rigorous internal checks of the venue and its own equipment to ensure that they are clean and safe.

Please ensure that your child goes to the toilet before class and brings a bottle of water, if desired, into class.

Changes to Terms and Conditions

KADA from time to time updates these T&Cs. It will inform you of changes through regular channels of communication and you have 14 days to opt out of accepting changes in writing. KADA will treat this agreement with you as being accepted if you fail to contact us.

By enrolling my son/daughter into KADA, I confirm that I accept the above terms and conditions/policies.
